The Holiday Giveaway (“Giveaway”) is sponsored by Mr. Chill Cooling & Heating Services LLC, a Texas limited liability company, located in Bastrop, Texas (“Sponsor”).
The Giveaway is open only to legal residents of Bastrop County, Texas, age 18 or older, who own or reside in a home with an existing HVAC system. The nominated HVAC system must be located at the nominee’s primary residence. Rental properties, investment properties, vacation homes, or commercial buildings are not eligible. The home must be structurally suitable for safe installation of a standard HVAC system, including adequate electrical supply, installation space, and compliance with local codes. If modifications are required to make the home suitable, such modifications are not included in the prize and will be the responsibility of the homeowner. Employees, officers, contractors, and immediate family members of Sponsor are not eligible. Entrants may nominate themselves or another eligible individual.
To enter, complete the official nomination form available through Sponsor’s designated website or other approved entry method. Each entry must include: (a) name and contact information of nominee; (b) description of nominee’s existing HVAC system, including approximate age; and (c) reason for nomination. Limit: one entry per household. Duplicate or incomplete entries may be disqualified.
All eligible entries will be reviewed by Sponsor. Winner must reside in Bastrop County, Texas, and the nominated system must be verified as being at the winner’s primary residence. Sponsor reserves the right to inspect the nominated system prior to awarding the prize. The decision of Sponsor is final and binding in all respects.
One (1) Prize: One winner will receive a new HVAC system replacement suited to their home’s size and needs, including standard installation at no cost. Prize includes standard installation of the new HVAC system at the winner’s primary residence. Exclusions: The prize does not include duct modifications, indoor air quality (IAQ) products, zoning, electrical upgrades, structural modifications, permits, or any other ancillary services not expressly stated. If required for installation, such services are the responsibility of the homeowner. Taxes: Winner is solely responsible for all applicable federal, state, and local taxes, including income taxes arising from acceptance of the prize. Sponsor will issue an IRS Form 1099 to the winner for the fair market value of the prize if required by law.
The potential winner will be notified by phone and/or email within five (5) business days of selection. Winner must respond within seven (7) business days of notification. Failure to respond may result in disqualification and selection of an alternate winner. Winner must allow Sponsor access to the property to verify system eligibility and to perform installation. Winner must sign a liability/publicity release prior to installation.
By entering, participants agree to abide by these Terms & Conditions and the decisions of Sponsor. Winner agrees to permit Sponsor to use their name, likeness, photographs, video, and testimonials for promotional purposes in all media, without compensation. Sponsor reserves the right to substitute the prize with one of equal or greater value, cancel, or modify the Giveaway at any time due to technical, legal, or business reasons.
Sponsor is not responsible for late, lost, misdirected, or incomplete entries. Sponsor shall not be liable for any indirect, incidental, or consequential damages arising from participation in the Giveaway or acceptance/use of the prize. HVAC system installation will be performed according to industry standards, but Sponsor makes no warranty beyond the standard manufacturer’s warranty and Sponsor’s applicable labor warranty.
The Giveaway is governed by the laws of the State of Texas. Any disputes shall be resolved individually, without resort to class action, exclusively in the state or federal courts located in Travis County, Texas.
Personal information collected will be used solely for administration of the Giveaway and in accordance with Sponsor’s privacy practices.
